Terms of Service
Effective December 10, 2025
1. Agreement
These Terms of Service govern your access to the Pep Payments website and any payment consulting, onboarding, integration, monitoring, or support services we provide. By using the website or engaging our services, you agree to these terms. If you act for a business, you confirm that you have authority to bind that business.
2. Eligibility and accurate information
You must be at least 18 years old and legally able to enter a binding agreement. You must provide complete, accurate, and current information about your business, products, ownership, websites, transaction activity, and customers. You must promptly tell us if that information changes.
3. Services
We help eligible businesses identify and implement payment-processing arrangements. Specific services, fees, timing, supported payment methods, and responsibilities may be set out in a separate proposal or service agreement. We may use third-party processors and technology providers. Approval, account continuity, settlement timing, and transaction acceptance remain subject to their rules and decisions.
4. Acceptable use
You may not use our website or services for unlawful, fraudulent, deceptive, infringing, or abusive activity; to misrepresent products or transaction details; to evade sanctions or legal requirements; or to interfere with our systems. You are responsible for complying with laws, card-network rules, refund obligations, advertising requirements, and consumer-protection requirements applicable to your business.
5. Fees and payment
You agree to pay the fees stated in your accepted proposal or service agreement, together with applicable taxes. Unless that agreement says otherwise, fees are non-refundable once services have begun. Late or failed payments may result in suspension of service and recovery of reasonable collection costs.
6. Your customers and disputes
You remain solely responsible for your products, claims, fulfillment, customer service, refunds, chargebacks, taxes, and disputes. We do not become the seller of your products and do not guarantee that a processor, bank, card network, or customer will accept any transaction.
7. Intellectual property
Pep Payments and its licensors retain all rights in the website, branding, software, documentation, and service materials. We grant you a limited, non-exclusive, non-transferable right to use materials supplied to you solely for receiving the services. You retain ownership of your business information and materials.
8. Confidentiality and data
Each party must protect confidential information received from the other and use it only for the agreed services. Our handling of personal information is described in our Privacy Policy. You must not send us full payment-card numbers, security codes, or other sensitive authentication data unless we expressly provide an approved method.
9. Suspension and termination
We may suspend or terminate access where we reasonably believe there is fraud, unlawful activity, material misrepresentation, security risk, non-payment, a breach of these terms, or a requirement from a processor or authority. You may stop using the website at any time, subject to obligations in any separate service agreement.
10. Disclaimers
The website and services are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted access, a specific approval rate, processor acceptance, or freedom from holds, reserves, disputes, or account action.
11. Limitation of liability
To the fullest extent permitted by law, Pep Payments will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity. Our total liability arising from the services will not exceed the fees you paid us during the three months before the event giving rise to the claim. Nothing excludes liability that cannot legally be excluded.
12. Changes and contact
We may update these terms to reflect legal, operational, or service changes. The revised version applies when posted, unless the law requires additional notice. Questions about these terms may be submitted through the Book a Call form on our website.
